Driving Economic Growth Through Privatization

Since independence in 1963, Kenya has aimed to boost economic development and citizen participation through the establishment of parastatals.

Over time, reviews revealed inefficiencies and recommended privatization to enhance performance and reduce public sector burdens.

The 1992 Policy Paper initiated significant privatization efforts, leading to improved infrastructure and economic growth.

Today, privatization continues to drive Kenya’s development by fostering a competitive, market-driven economy.

Privatization is a transaction that results in the transfer, other than to a public entity, of the assets and/or liabilities of a public entity, including the shares in a public entity.
The Privatization Commission is a corporate body established under Section 3 of the Privatization Act (2005) to formulate, manage and implement the Privatization Programme.
The Privatization Programme is a list of public sector assets and operations approved by the Cabinet to be considered for privatization and subsequently privatized once the approval process is completed.
The desired benefits from privatization are listed under Section 18 (1) of the Privatization Act 2005. They include but are not limited to the following:
  • Improvement of infrastructure and the delivery of public services by the involvement of private capital and expertis
  • Reduction of the demand for government resources
  • Generation of additional government revenues by receiving compensation for privatizations
  • Improvement of the regulation of the economy by reducing conflicts between the public sector's regulatory and commercial functions
  • Improvement of the efficiency of the Kenyan economy by making it more responsive to market forces
  • Broadening of the base of ownership in the Kenyan economy
  • Enhancement and development of the capital markets.
  • The National Treasury and Economic Planning Cabinet Secretary formulates the programme through consultation with affected parties, submits it to the Cabinet for approval, and then forwards it to the National Assembly for ratification. Once ratified, it is published in the Kenya Gazette.
    The Privatization Commission implements the programme in accordance with the Privatization Act, 2005.
    Implementation involves assessing the entity's position, developing a proposal for Cabinet approval, conducting a business evaluation to determine the reserve price, and privatizing the entity using the approved method.
    Proceeds from privatization are paid into the Consolidated Fund.
    Any person, whether Kenyan or non-Kenyan, can participate. However, the Cabinet Secretary, National Treasury and Economic Planning, may limit participation to Kenyans only.

    The Government of Kenya (GOK), through the Privatization Commission, has invited prospective investors to submit bids for the acquisition of GOK shareholdings of KWAL Holdings (E.A) Limited (KHEAL) and Kenya Wine Agency Limited (KWAL) by 26th August 2024. GOK shareholdings of KHEAL and KWAL comprise 43.77% and 0.0000125% respectively.

    The Privatization Commission donated 17,800 tree seedlings during the 7th Edition of the Kaptagat Annual tree planting event at Kessup Forest in Elgeyo Marakwet. Sourced from Kericho Medium Prison and Ngeria Prison in Eldoret, these seedlings were part of the Authority's CSR efforts. Represented by Board Chairman Mr. Faisal Abbas and Executive Director Mr. Joseph Koskey, the Authority helped plant 32,000 trees, supporting the Presidential directive to plant 15 billion trees by 2032.

    The Government of Kenya, through the Privatization Commission, invites investors to acquire 33.83% of its shareholding in Kenya Hotel Properties Limited (KHPL) by 18th April 2024. Established in 1966, KHPL owns a prime property in Nairobi's Central Business District, previously managed by the Intercontinental Hotel Group, near the National Parliament building.

    SANITARY TOWELS DISTRIBUTION

    Privatisation Authority has donated over 900 packets of sanitary towels to Imani Rehabilitation Agency in Soweto Kayole. This CSR initiative aims to provide medical health support to vulnerable groups. Project Manager Gillian Njeru highlighted the critical challenge of accessing sanitary pads for many girls in the agency, causing discomfort and embarrassment. Additionally, the Authority's officers donated food, clothes, and toys as personal contributions.
